Terms of Use

These terms govern your use of abc-corridor.com and any page, directory, opportunity board or download made available on it. By using the site you accept them. If you do not accept them, do not use the site. Where you subscribe to the Corridor Passport, the subscription agreement governs the service and prevails over these terms in the event of conflict.

1. Who operates the site

1.1

The site is operated by Openet B.V., Willem de Zwijgerlaan 350, 1055 RD Amsterdam, the Netherlands, Chamber of Commerce 75227312, VAT NL860196951B01, on behalf of the Arab–Balkans Corridor, a BDS Holding B.V. initiative.

2. Use of the site

2.1

You may view, download and print pages for your own business use. You may not reproduce, republish, sell or systematically extract content without our written consent.

2.2

You may not use automated means to scrape, index or copy the directory or any listing, attempt to gain unauthorised access, introduce malicious code, or interfere with the operation of the site.

2.3

You may not use any contact detail obtained from the site for unsolicited marketing.

2.4

We may suspend or withdraw access to all or part of the site without notice, and are not liable if it is unavailable at any time.

3. Accounts and accuracy of information

3.1

Where the site allows you to create an account or submit a profile, you are responsible for keeping your credentials confidential and for all activity under them.

3.2

You warrant that information you submit is accurate, that you are authorised to submit it on behalf of the organisation named, and that it does not infringe any third party right.

3.3

We may edit, refuse or remove any submission, listing or opportunity board post at our discretion, in particular where it appears inaccurate, misleading, unlawful or contrary to the purpose of the corridor.

4. The directory, listings and introductions

4.1

A listing records that the stated verification steps were carried out on the information supplied at the time. It is not a warranty of the solvency, capacity, quality, conduct or continuing standing of any listed party.

4.2

Verification is not an endorsement, a credit assessment, a certification of goods, or advice on whether to trade with any party.

4.3

Where we introduce two parties, we do so as an introducer only. We are not a party to any contract they conclude, take no position in it, and are not liable for its performance.

4.4

You remain responsible for your own due diligence, sanctions and anti-money laundering screening, and contractual protections.

5. Information, briefings and origin material

5.1

Content on the site, including bulletins, sector briefs, tariff and regulatory alerts and origin material, is general information about trade conditions. It is not legal, customs, tax, financial or investment advice and must not be relied on as such.

5.2

Tariff treatment, preferential origin, customs classification and regulatory requirements depend on the facts of each shipment and on decisions of the competent authorities. You should obtain binding rulings or professional advice before acting.

5.3

We take reasonable care in preparing content but do not warrant that it is complete, current or free from error.

6. Intellectual property

6.1

All content on the site, including text, layout, graphics, maps and the Arab–Balkans Corridor and Corridor Passport names and marks, is owned by or licensed to Openet B.V. or BDS Holding B.V. and is protected by copyright and trade mark law.

6.2

The Union of Arab Chambers name and marks are the property of that organisation and may not be used without its consent.

6.3

You grant us a non-exclusive, royalty-free licence to publish and circulate material you submit for a listing or the directory, for the purposes of operating the corridor. You may withdraw it by asking us to remove the listing.

7. Third party links

7.1

The site may link to third party sites. We do not control them, do not endorse them and are not responsible for their content or their handling of your data.

8. Liability

8.1

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded.

8.2

Subject to clause 8.1, we are not liable for loss of profit, revenue, business, goodwill or anticipated savings, for loss arising from reliance on site content, or for any indirect or consequential loss.

8.3

Subject to clause 8.1, our total liability to any user in connection with use of the site is limited to five hundred euro (€500), or, where the user is a subscriber, to the limit set out in the subscription agreement.

8.4

The site is provided on an “as is” and “as available” basis. All warranties implied by law are excluded to the fullest extent permitted.

9. Privacy and cookies

9.1

Personal data collected through the site is processed in accordance with the Privacy Notice published at abc-corridor.com.

9.2

Cookies are used as described in that notice. Non-essential cookies are set only with your consent.

10. Changes, law and jurisdiction

10.1

We may amend these terms at any time by publishing a revised version. The version in force when you use the site applies to that use.

10.2

These terms and any non-contractual obligation arising out of them are governed by the laws of the Netherlands.

10.3

The courts of Amsterdam have exclusive jurisdiction, save that where you are a consumer you may also bring proceedings in the courts of your place of residence and retain the protection of the mandatory law of that country.
